The Capital Market Authority (CMA) has taken significant steps to protect investors by approving two class-action lawsuits against Maena Investment Co. and 2060 Agricultural Co.. These legal actions arise from allegations that both companies failed to comply with essential regulatory protocols when advertising shares for subscription to investors.
Background of the Lawsuits
According to reports from the CMA, the first class-action lawsuit is the result of a complaint filed by an investor against Maena Investment Co. The investor claims that the company heavily promoted share subscriptions through television advertisements and social media channels without adhering to the regulatory requirements outlined in the Rules on Offer of Securities and Continuing Obligations.
The investor, who relied on these promotions to make his subscription, is seeking to annul his agreement with the company and has requested a refund of the amounts paid.
Similarly, the second class-action lawsuit concerns allegations against 2060 Agricultural Co. An investor has accused the firm of offering shares without following the necessary regulatory procedures. Like the first case, this investor also requested the annulment of the subscription agreement and a refund.
Call for Additional Complainants
In light of these developments, the CMA has announced that any investor who purchased shares from either of the implicated companies can submit a request to join these class-action lawsuits. Interested parties have a window of 90 days from the announcement date to make their claims, potentially allowing more affected investors to seek redress for their grievances.
The CMA's approval of these lawsuits underscores its commitment to enforcing regulatory compliance and protecting the rights and interests of investors in the market.
