Kalshi Challenges Netflix Over ‘Prediction Games’ Trailer

Kalshi, a popular platform for prediction markets, has formally requested Netflix to remove the trailer for its upcoming documentary titled "Instadocs: The Prediction Games." In a cease-and-desist letter sent to the streaming giant, Kalshi claims that the trailer disseminates defamatory content and includes misleading statements regarding its operations.

Legal Grounds for the Cease-and-Desist

The trailer for "Instadocs: The Prediction Games" highlights various individuals engaging in betting activities linked to the World Cup, creating an implication that such betting is legal in Nevada. However, Kalshi is prohibited from operating within the state due to a court ruling. In its letter, Kalshi contends that the documentary incorrectly presents a situation where a guest appears to take part in betting legally, asserting this misrepresentation could confuse viewers.

Kalshi specifically pointed out that the trailer features footage from a party in Las Vegas where high-stakes bettors gathered to watch the World Cup final. During this event, one of the attendees is shown declaring, "I like betting on Kalshi," and another boasts about a $5,000 bet displayed on his phone.

Claims of Fabrication and Misleading Footage

Kalshi insists that the screenshot of the bet showcased in the trailer is an outdated order from May 16, 2025, well before the imposition of the Nevada ban. They argue that the documentary misleads viewers into believing that betting activities occurred in Nevada on July 19, 2026. The company further alleges that a Netflix employee previously agreed to exclude this receipt from the final documentary, yet it remains in the trailer.

In this context, Kalshi's letter states, "despite Kalshi demonstrating to this employee that the claims in the video were demonstrably false, Netflix inexplicably refused to remove the receipt from the trailer currently circulating on the homepage of the Netflix app."

Netflix's Response

In response to the accusations, Netflix has defended the accuracy of the trailer's contents. A spokesperson clarified that the footage was captured during the Winible World Cup Watch Weekend held in Las Vegas and confirmed that the featured trader was showing a legitimate bet made prior to the court order against Kalshi. Netflix maintained that it did not fabricate any footage included in the trailer, concluding that all trades and bets presented were conducted between individuals and the respective betting apps.

The dynamic between Kalshi and Netflix highlights the broader implications for media representations of betting markets, especially as companies seek to harness public interest in prediction markets.
